Conservatorship is a legal proceeding where you are asking a judge to give you decision-making authority over another adult who is unable to take care of their own person and/or manage their monies. Conservatorship is an extremely serious process and involves court supervision after it is established. As part of the conservatorship process, the court will ask why formal or informal supports aren’t enough to help a vulnerable adult.
SHCC provides legal information for certain probate conservatorship matters and will help you in the preparation of required forms.

Limited Conservatorship of Person and Small Estate
General Conservatorship: A conservatorship over an adult who is unable to properly provide for their personal needs for physical health, food, clothing, or shelter and/or manage their finances.
The typical conservatee in a general conservatorship is an adult suffering from a neurocognitive disability (i.e. traumatic brain injury/ Dementia/ Alzheimer’s disease).
Limited Conservatorship: Is designed to support the needs of a developmentally disabled adult whose disability originated before their 18th birthday, is expected to continue indefinitely, and constitutes a substantial impairment. The conservator is responsible for encouraging the maximum self-reliance of the conservatee.
LPS Conservatorship: For a person who, as a result of a mental disorder, is gravely disabled,
unable to provide for their basic personal needs for food, clothing, or shelter. These matters are heard by the Mental Health Court. Cases are initiated after a an investigation of the Public Guardian.
A conservator of the person manages the conservatee’s daily needs
A conservator of the estate manages the conservatee’s finanaces
Conservator: The person over the age of 18 appointed by the court to carry out the duties under the established conservatorship.
Co-Conservator: Co-conservator(s) refer(s) to more than one individual or entity acting as a conservator.
Conservatee: A person whom a judge has decided is unable to care for themselves or to manage their own financial affairs.
